HOKUS eBikes — Terms & Conditions

  • Definitions

    • Hokus / We / Us: Hokus eBikes - registered as HOKUS E-BIKES PTY. LIMITED, based in the Illawarra, NSW.
    • Product(s): Any e-bike, battery, or accessory sold by Hokus.
    • Consumer / You: The person or entity purchasing the Product.
    • Agreement: The contract between Hokus and the Consumer, governed by these T&Cs.
  • Prices and Payment

    • Currency: All prices are in Australian Dollars (AUD) and include GST unless stated otherwise.
    • Advance Payment: Full payment is required before shipment unless otherwise agreed in writing.
    • Legal Title: Hokus retains ownership of all Products until the purchase price, including shipping, is paid in full.
  • Delivery and Passing of Risk

    • Estimates: Delivery dates are estimates only. Hokus is not liable for delays caused by third-party carriers.
    • Risk Transfer: For Consumers, the risk of loss or damage passes to you upon delivery. If you are picking up from a Hokus service point, risk passes upon your physical possession of the bike.
    • Assembly: Hokus bikes may require minor assembly (pedals/handlebars). As an electrician-led brand, we provide detailed guides and videos. Failure to follow these instructions may void your warranty.
  • Inspection and Defects

    • 5-Day Rule: You must inspect the Product upon arrival. Any cosmetic damage or discrepancies must be reported in writing within 5 calendar days.
    • Immediate Cease-Use: If a defect is discovered, you must stop using the Product immediately. Continued use after discovering a fault (especially with electrical/battery components) voids your right to a claim.
  • (Limited) Warranty

    • Coverage: Our full Warranty Policy is incorporated here by reference. We provide a 3-year frame warranty and a 2-year electrical/battery warranty.
    • Battery Health: We guarantee 65% capacity over 2 years. Normal degradation is expected and is not a defect.
    • 2026 Compliance: All Hokus products are built to meet or exceed 2026 NSW Fair Trading safety standardsfor lithium-ion batteries.
  • User Responsibility and Safety

    • Competency: By purchasing, you represent that you are a competent rider and understand the local laws pertaining to e-bikes.
    • Maintenance: E-bikes require regular maintenance. Failure to perform basic checks (brakes, tire pressure, bolt tension) is a misuse of the Product.
    • Modifications: Any "tuning" or modification of the speed limiter or electrical system by non-Hokus personnel will result in an immediate termination of the Agreement and Warranty.
  • Liability

    • Limitation: To the extent permitted by law, Hokus’s total liability for any claim is limited to the amount paid for the Product.
    • Indirect Loss: Hokus is not liable for incidental, punitive, or consequential damages (such as lost wages or medical costs) arising from the use of the Product.
    • Indemnity: You agree to indemnify Hokus against any claims from third parties arising from your use of the bike.
  • Right of Withdrawal (Returns)

    • 14-Day Window: For online purchases, you have 14 days to return the bike for a refund, provided it is in "as-new" condition and in its original packaging.
    • Diminished Value: You are liable for any wear and tear or damage that occurs during this 14-day trial period.
  • Force Majeure

    • Hokus is not liable for failure to perform due to circumstances beyond our control, including but not limited to fires, floods, global supply chain stagnation, or government-mandated battery safety recalls.

Applicable Law

These T&Cs are governed by the laws of New South Wales, Australia. Any disputes shall be handled by the competent courts in the State of New South Wales.
